DATA PROTECTION STATEMENT
for the “Pink Kisses® Social Media Raffle FRIENDSHIP TATTOO STICKERS from 12.09.-20.09.2020”

- Object and organiser/responsible person
1.1 These conditions of participation with data protection statement regulate the participation in the competition with advertising character “Pink Kisses® Social Media Competition FRIENDSHIP TATTOO STICKERS from 12.-20.09.2020” as well as the collection and use of the data provided by the participants. We would like to point out that female pronouns are used throughout the following text for the sake of simplicity. Of course, not only women are entitled to participate in this competition.
1.2 By participating in the competition, you as a participant accept these conditions of participation.
1.3 The organiser of the competition and responsible within the meaning of the GDPR is us, Selecta Klemm GmbH & Co. KG, Hanfäcker 10, 70378 Stuttgart, info-de@selecta-one.com, Tel. +49 711 95325-0.
1.4 We reserve the right to discontinue the competition at any time, i.e. to terminate or amend the competition in whole or in part even before the end of the promotion period, if the proper execution of the competition is not possible for technical or legal reasons.
- Participation & entry deadline
2.1 Only persons who are at least 18 years of age at the time of entry and are a permanent resident of the European Union or the United Kingdom are eligible to enter the competition. Irrespective of this, our employees and employees of the agency commissioned by us (pro in space GmbH), including companies affiliated with them, are not entitled to participate. Persons not entitled to participate shall not be entitled to any prize even if a prize is allocated.
2.2 Participation takes place by an eligible person leaving a comment under the entry of 12.09.2020 in the Pink Kisses Flowers page timeline on Facebook (@pinkkissesflowers) or under the post on the Pink Kisses Flowers channel on Instagram (@pinkkisses_flowers), in which the competition question “What name would be on your friendship tattoo?” is answered.
2.3 Start of the campaign: The competition starts on 12.09.2020 with the publication of the posts mentioned under 2.2 on Facebook and Instagram.
2.4 End of action/end of participation: The competition ends on 20.09.2020, 23:59 hrs – CET.
2.5 The person willing to participate must have a valid Facebook or Instagram account (for which separate registration with the respective provider and the provision of personal data are required) in order to participate in the competition. The competition is independent of Facebook or Instagram and is neither sponsored, organised nor otherwise supported by the platforms. By participating, the participant indemnifies Facebook and Instagram from all claims arising from this.
2.6 Participation is free and independent of the purchase of goods or services. Each participant can only participate in her own name. Prizes cannot be transferred to third parties. Each participant can only participate once and each participant can only win one prize. Prizes cannot be paid out in cash. Prizes may not be exchanged.
2.7 Participants undertake to behave respectfully and politely towards other users in connection with the competition, to maintain an appropriate tone of voice, not to share any illegal content and to respect third-party copyright and personal rights. We reserve the right to exclude contributions from the competition which do not comply with these rules.
- Prizes, determination of winners and notification of winners
3.1 Prizes: A total of 20x 16 “Fake Tattoo” skin stickers individualised with two names in a size of approx. 4×4 cm will be raffled off. The winners can choose one of three motifs to be presented on the Instagram and Facebook channels.
For the winners, the lettering will be replaced by two names of their choice.
3.2 The prizes will be raffled off by us half each among all comments posted by eligible persons and valid according to these regulations under the competition entry on Facebook mentioned under 2.2 and the Instagram Post mentioned under 2.2.
3.3 The winners will be announced by the end of 22.09.2020 by marking them in a comment under the competition entry and asked to write us a Facebook or Instagram message with the shipping address.
The winners are obliged to register by 27.09.2020. If they do not reply by the above-mentioned date, the prize will be forfeited and a replacement winner will be selected and notified.
3.4 We make no warranties or guarantees whatsoever in connection with the prizes with regard to their freedom from defects.
- Final clauses
Should the above terms and conditions of participation contain invalid provisions, the validity of the remaining provisions shall remain unaffected. Legal recourse is excluded. German law applies.
- Data protection information
We, Selecta Klemm GmbH & Co. KG, are responsible for the collection, processing and use of the personal data of the participants. KG (see point 1.3). The data collected in the course of the competition is required by us to check your eligibility to participate and to send you the prize.
Your data will be used exclusively for the purpose of conducting the competition and will be deleted within six weeks of the closing date for participation, insofar as we no longer need it to process the prizes or are legally obliged to store it for a longer period.
Insofar as necessary, we shall be entitled to pass on your data collected in the course of the competition to third parties for the purposes of implementing and processing the competition, namely pro in space GmbH, Cologne, which has been commissioned by us with the implementation and processing of the competition and the mail-order companies which have been commissioned with the dispatch of the prizes.
We will not pass on your data to third parties beyond this.
The legal basis for the above-mentioned data processing is Art. 6 para. 1 sentence 1 lit. a GDPR. The legal basis for the six-week storage is also Art. 6 para. 1 sentence 1 lit. f GDPR. Our interest in storage is justified by the fact that you may wish to assert claims in connection with the competition during this period.
