- Subject matter and organiser/responsible person
1.1 These terms and conditions of participation with data protection statement govern the participation in the raffle with promotional character “Pink Kisses® Social Media Competition SEND A CARD TO A FRIEND DAY 2021 from 07.-09.02.2021” as well as the collection and use of the data provided by the participants.
1.2 By entering the competition, you as a participant accept these terms and conditions.
1.3 The organiser of the competition and the person responsible in accordance with the GDPR is us, Selecta Klemm GmbH & Co. KG, Hanfäcker 10, 70378 Stuttgart, firstname.lastname@example.org, Tel. +49 711 95325-0.
1.4 We reserve the right to cancel the raffle at any time, i.e. to terminate it in whole or in part even before the end of the campaign period, or to modify it if the proper implementation of the raffle is not possible for technical or legal reasons.
- Participation & closing date
2.1 Only persons who are at least 18 years of age at the time of participation and are a permanent resident of the European Union or the United Kingdom are entitled to participate in the raffle. Notwithstanding the above, our employees and employees of the agency commissioned by us (pro in space GmbH), including companies affiliated with them, are not entitled to participate. Persons who are not eligible to participate will not be entitled to any prize, even if a prize is awarded.
2.2 To enter, an eligible person must leave a comment under the post of 07.02.2021 on the Pink Kisses Flowers page chronicle on Facebook (@pinkkissesflowers) or under the post on the Pink Kisses Flowers channel on Instagram (@pinkkisses_flowers) asking the raffle question “Who would you like to send a postcard to?“.
2.3 Promotion start date: The raffle will start on 07.02.2021 with the publication of the posts mentioned under 2.2 on Facebook and Instagram.
2.4 End of promotion/closing date: The end of the raffle is 09.02.2021, 23:59 – CET.
2.5 The person wishing to participate must have a valid Facebook or Instagram account (for which a separate registration with the respective provider and the provision of personal data are required) in order to participate in the raffle. The raffle is independent of Facebook or Instagram and is neither sponsored, organised nor otherwise supported by the platforms. By participating, the participant releases Facebook and Instagram from all claims arising therefrom.
2.6 Participation is free of charge and independent of the purchase of goods or services. Each participant may only enter on her own behalf. Prizes cannot be transferred to third parties. Each participant can only participate once and each participant is only eligible for one prize. Prizes cannot be paid out in cash. The exchange of prizes is excluded.
2.7 Participants undertake to behave respectfully and politely towards other users in connection with the raffle, to maintain an appropriate tone, not to share illegal content and to respect the copyright and personal rights of others. We reserve the right to exclude entries from the raffle that do not comply with these rules.
- Winning, prize determination and prize notification
3.1 Prizes: A total of 20x nine postcards with three different designs (three of each design) will be raffled.
3.2 We will draw half of the prizes from each of the valid comments posted by eligible persons in accordance with these terms and conditions under the raffle post on Facebook referred to in 2.2 and the Instagram post referred to in 2.2.
3.3 The winners will be announced by the end of 10.02.2021 by tagging them in a comment under the raffle call and asked to write us a Facebook or Instagram message with the shipping address.
3.4 The winners are required to get back to us by 12.02.2021 10.00 am. If they fail to do so by the aforementioned time, the prize will be forfeited and a replacement winner will be selected and notified.
3.5 We do not provide any warranty or guarantee in connection with the prizes with regard to their freedom from defects.
- Final provisions
Should the above conditions of participation contain invalid provisions, the validity of the remaining conditions shall remain unaffected. Legal recourse is excluded. German law applies.
We, Selecta Klemm GmbH & Co. KG (see section 1.3), are responsible for the collection, processing and use of the participants’ personal data. The data collected as part of the raffle is required by us to check your eligibility and to send you the prize.
Your data will be used exclusively for the purpose of conducting the raffle and will be deleted within 6 weeks of the closing date for entries if we no longer need it to process the prizes or are legally obliged to store it for a longer period.
Insofar as necessary, we are entitled to pass on your data collected within the scope of the raffle to third parties for the purposes of carrying out and processing the raffle, namely pro in space GmbH, Cologne, which has been commissioned by us to carry out and process the raffle, as well as the shipping companies which are commissioned to send the prizes.
Beyond this, we will not pass on your data to third parties.
The legal basis for the aforementioned data processing is Art. 6 para. 1 p. 1 lit. a GDPR. The legal basis for the 6-week storage is also Art. 6 para. 1 p. 1 lit. f GDPR. Our interest in storage is justified by the fact that you may wish to assert claims in connection with the raffle during this period.
